The following was posted at AFP. You might have already seen it. My question is this, by what authority do these people have to remove any signs? IF the signs are in violation of a city ordinance, isn't it up to the city attorney and a court to enforce the ordinance? Thanks in advance.

Give Points I have heard talk that the Mayor is having city employees going out on the taxpayers dime to pick up the signs that Fred Reese is putting out. This is so untrue!! His supporters city employes or others are doing it after hours on their own dime. In the first place the signs are not legal as they do not have the disclaimer about, Paid for by the committe to elect >>>> and then they have been put in public right aways and on poles. Both are not legal. Here is the following ordinance regarding it.

Here is the law:

IC 3-14-1-3
Circulation or publication of anonymous campaign material
Sec. 3. An individual, an organization, or a committee that circulates or publishes material in an election without the statement required under IC 3-9-3-2.5 commits a Cl*** A misdemeanor.
As added by P.L.5-1986, SEC.10. Amended by P.L.10-1988, SEC.206; P.L.5-1989, SEC.71; P.L.3-1997, SEC.400.

Indiana State Law requires that all campaign materials have a notice saying the name of the political committee or candidate who paid for it. I forget the wording but the law is specific.
If Ocky had done the same, you bet the Repubs would have pitched a bitch.

You didn't answer my question. I'm NOT asking if the signs are legal or not. I'm asking if the signs are in fact "not up to code" so to speak, do these "citizens" have a right to remove them?? Forget about Smith or Ockomon, that's not my question.

Seems to me that the persons removing them are no better than anyone else who steals or damages the signs. Follow me?

If I see a car speeding, I have no right to stop it and issue a ticket, so wouldn't it be the same with the signs? I don't think I'd have a right to remove them either. Correct??

I see your point. I believe there is an ordinance that forbids signs being posted on right a ways and such. This would give the city the right to remove them. As for the State Law, it certainly allows the police to collect evidence.
Also, if it is on city property then of course the city can remove them.
I guess they will say they are collecting evidence which gives them a legal duty to do so if the Chief of Police says they can.
IN fact, if a police man asks you to ***ists him in his duties, you may be obligated to do so.

IC 35-44-3-7
Refusal to aid an officer
Sec. 7. A person who, when ordered by a law enforcement officer to ***ist the officer in the execution of the officer's duties, knowingly or intentionally, and without a reasonable cause, refuses to ***ist commits refusal to aid an officer, a Cl*** B misdemeanor.
As added by Acts 1976, P.L.148, SEC.4. Amended by Acts 1977, P.L.340, SEC.65.

Ok, but here is the kicker. Check what the poster said at AFP, and I quote:

"His supporters city employes or others are doing it after hours on their own dime".

So, that makes the people who are taking them no different than you or me. That is NOT the way you collect evidence. We both know that.

Come on Paul, you're grasping at straws. You and I both know that they aren't being directed by the police. And, unless there is a court order, I don't think the police have authority to remove them from private party. Correct me if I'm wrong, but if you do, by what authority? Statute, etc.?

I'm going to try and locate one of the Ockomon hires his family thingy signs for the fall election. Maybe they'd come on my yard to remove it. Would you file tresp*** charges against them for me Bitterguy?
